road boss trailers

How much should I sue my boss for? (details inside)?

I borrowed his trailer (not the one he lives in) to haul some lumber I had sawed to dry it and use in my new house. I was gonna run down to the new house at lunch and start loading the lumber and finish it in the morning.

Since I was in a huge hurry, I ran to the closest convenience store and got a pack of nabs, some honey roasted peanuts and a coke (which was hot) for lunch and started the 10 mile trip to the house. I didn’t make it 3 miles down the road when one of the trailer tires blew out and so I ended up pulling over and changing it on the side of the road. By the time I got it changed and took the trailer to the house, my lunch hour was pretty well shot to hell.

So, for the pain and suffering of the embarrassment from changing a tire on the side of the road and having had what we’ll call a crappy lunch and wasting my entire lunch hour because of his faulty tire, what should I stick him for? If he is content to settle out of court, what kind of break is that worth?

Let’s look at this a different way.
You are obviously a trusted employee. How else would you have the keys to the trailer? Or if you stole them, a clearly motivated and “get it done” type. A big plus.
The fact that you used your lunch hour, or two, only shows that you are a “take charge of the situation” type. Another plus.
You show excellent time management thinking by stopping at the 7-11. Another big plus.
Now, after realizing the un-road worthy condition of the trailer, you took it upon yourself to protect the company from potential future liabilities by fixing the tire. Kudos to you.
However you may want to down play the selection of foods you bought. And, you may want to avoid bring up the “coke” part. I don’t know if it was in the liquid or powder form. Not really my business.
I’m not sure about the claim you have for “embarrassment”. If you displayed a huge butt crack while performing the needed maintenance, you may want to check with your HMO.
I do expect that you may well have him simply give you the trailer. Not only will it be handy as you build your new house, but it could well serve, with that new shiny tire, as a real babe magnet.
I hope you saved the old tire! There is nothing that says “home” like an old tire planter filled with pretty plastic flowers.
